Void outside the 48 contiguous United States, District of Columbia and where prohibited. Do not proceed to enter if you are not at least 13 years of age and a legal resident of, and located within, one of the 48 contiguous United States or the District of Columbia at the time of entry. By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this contest.
NO PURCHASE IS NECESSARY TO SUBMIT A NOMINATION OR BE SELECTED AS AN AWARD RECIPIENT. A PURCHASE WILL NOT INCREASE A NOMINEE'S CHANCES OF RECEIVING AN AWARD.
Successful Farming Magazine and Agriculture.com are asking readers and site viewers to tell us about a remarkable farmer veteran who is an active farmer or works in an active farming operation, and maintains involvement in the community or volunteers in the community or for an organization. For the purposes of this contest an active farmer/active farm operation is defined as deriving at least 50% of its income from a farming enterprise.
NOMINATION PERIOD: Contest begins at 12:01 a.m. Central Standard Time ("C.S.T.") on 3/1/17 and ends at 11:59 p.m. C.S.T. on 4/30/17 ("Nomination Period"). Online nominations must be received by 11:59 p.m. C.S.T. on 4/30/17. Mail-in nominations must be postmarked on or before 4/29/17 and be received by 5/8/17. The contest is sponsored by Meredith Corporation, 1716 Locust St., Des Moines, IA ("we," "us," "our" or "Sponsor"). SUBMIT A NOMINATION: During the Nomination Period you ("you," "your" or "Nominator") may nominate a veteran who is an active farmer or works in an active farming operation, and maintains involvement in the community or volunteers in the community or for an organization ("Nominee"). To be eligible, a nomination should include the following if available: (1) your name, address, e-mail address, daytime phone number, and relationship to the Nominee; (2) the Nominee's name, address, e-mail address, and daytime phone number; (3) an essay (in 200-500 words) explaining the Nominee’s military service, farming operation, and involvement in the community; (4) if the Nominee has a service-connected disablilty (optional); (5) one (1) photo of the nominee (optional), and or video (maximum 5 minutes), (6) testimonials that help to explain the Nominee’s military service, farming operation, and involvement in the community (each a “Nomination”)
There are two ways to submit a Nomination: 1) Online: Visit www.agriculture.com/fightertofarmer and follow the directions provided to submit your Nomination, and any other accompanying materials; or 2) Via Mail: Type or write the Nomination and any other accompanying materials and send in an envelope affixed with proper postage to: SUCCESSFUL FARMING FIGHTER TO FARMER SWEEPSTAKES LS-257, Des Moines, IA 50309-7290.
There is no cost to submit a Nomination. Nominations will become our property and will not be acknowledged or returned. You may submit only one (1) farmer veteran Nomination per day regardless of method of entry, but you may nominate more than one farmer veteran on separate days. Limit five (5) different farmer veteran Nominations submitted per person regardless of method of entry throughout the Nomination Period.
Nominations must (i) be original (written by you), (ii) be in English, (iii) not be previously published or submitted in connection with any other promotion and may not have won any award, (iii) be in keeping with our image and (v) not be offensive or inappropriate, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or property rights or any other third party rights (including the rights of the Nominee and the organization and/or charity associated with the Nomination). Nominations that are fictional or exceeding the required length will not be considered. All Nominations are final upon submission. We may reject and/or disqualify any Nominations, subjects, or related materials that we deem to be obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with our editorial standards, audience expectations, or reputational interests or that we believe may violate any applicable law or regulation or the rights of any third party. We may verify any element of any Nomination or related materials, request additional information or disqualify any Nominator whose participation may subject us, the contest, our advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. Any content submitted in the Nomination may not contain, as determined by the Sponsor, in its sole discretion, any content that:
• is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
• promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
• is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
• defames, misrepresents or contains disparaging remarks about other people or companies;
• contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others;
• contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
• contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media;
• contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead;
• contains look-alikes of celebrities or other public or private figures, living or dead;
• communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or
• violates any law.
By submitting your Nomination, you agree that your Nomination conforms to these Official Rules and that we may disqualify your Nomination for any reason, including if we determine that your Nomination fails to conform to these Official Rules in any way or otherwise contains unacceptable content.
ELIGIBILITY: We welcome nominations from legal residents of the 48 contiguous United States and the District of Columbia, who are 13 years and older. Eligible minors must obtain their parents or legal guardian’s permission prior to participating. Nominee must be a person you know, who is a legal resident of the 48 contiguous United States or the District of Columbia, 18 years or older. Nominators and Nominees may not be our employees and/or employees of Grasshopper Mowers and any other organizations affiliated with the sponsorship administration, award support, advertisement or promotion of the contest and/or their respective agents, affiliates, subsidiaries and their immediate family members (regardless of where they reside) or household members, whether or not related. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.
JUDGING: The entries will be divided into two separate pools for judging.
Judging first prize: The first round of judging will include all entries. On or about 6/1/17, a panel of qualified judges, selected by the Sponsor, in its sole discretion, will judge all eligible Nominations based on the following criteria equally: (i) impact of the Nominee's military service on their life or career in agriculture (25%); (ii) cumulative effect of the Nominee's involvement and efforts in the community (25%); (iii) relevance the nominee has to farming or agriculture (25%); and (iv) overall coherence of the written Nomination (25%). We may request additional information from you about your Nominee. The Nominee with the highest score will receive prize package #1.
Judging second prize: The second round of judging will include the entries of Nominees who have a service-connected disability. On or about 6/1/17, a panel of qualified judges, selected by the Sponsor, in its sole discretion, will judge all eligible Nominations based on the following criteria equally: (i) impact of the Nominee's military service on their life or career in agriculture (25%); (ii) cumulative effect of the Nominee's involvement and efforts in the community (25%); (iii) relevance the nominee has to farming or agriculture (25%); and (iv) overall coherence of the written Nomination (25%). We may request additional information from you about your Nominee. The Nominee with the highest score will receive prize package #2.
Decisions of judges are final and binding in all respects. Sponsor reserves the right not to award all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Prize awards are subject to verification of eligibility and compliance with these Official Rules.
WINNER NOTIFICATION: If your Nominee is selected as a potential Award Recipient, you and the Nominee will be notified by telephone, mail, or e-mail on or about 7/1/17. In the event of a tie, the Nomination with the highest score in the "relevance the nominee has to farming or agriculture" judging criteria will be deemed a potential Award Recipient. You and your Nominee will be required to complete and return an Affidavit of Eligibility, IRS W9 form and/or a Release of Liability/Publicity (unless prohibited by law) and any other documents that we require within ten (10) days of date of notification. In the event a Nominator or Nominee is a minor and deemed a potential Award Recipient, the parent or legal guardian of the minor must sign and return the Affidavit of Eligibility, IRS W9 form and/or a Release of Liability/Publicity on his/her behalf. If any requested documents are not returned within the specified time period, award notification is returned as undeliverable, we are unable to contact a potential Award Recipient within a reasonable amount of time or a potential Award Recipient is not in compliance with these Official Rules, we may choose to select the Nominee with the next highest score to receive the award. Decisions of judges are final and binding in all respects.
Prize package #1: One (1) Nominee will receive $6,000 in store credit to his or her local Grasshopper Mower dealer that may be used for the purchase of a mower and accessories and $4,000 awarded in the form of a check. The ARV of prize package #1 is $10,000.
Prize package #2: One (1) Nominee with a service-connected disablility will receive $6,000 in store credit to his or her local Grasshopper Mower dealer that may be used for the purchase of a mower and accessories; $4,000 awarded in the form of a check; and $5,000 in adaptive equipment or other goods and services for mower and or the Nominee’s farm to enhance the quality of life for the Nominee as decided upon by AgrAbility, equipment provider Life Essentials and the Nominee. The ARV of prize package #2 is $15,000.
Sponsor reserves the right to substitute any prize with a prize of comparable or greater value if a prize cannot be awarded as described. Sponsor will determine all elements of prizing in its sole discretion. Prizes may not be assigned, transferred, changed or redeemed for cash, except at Sponsor’s sole discretion. Prizes are awarded “as is” with no warranty or guarantee express or implied by Sponsor. Sponsor disclaims all and any liability for the actual provision, quality or nature of any third party products or services accepted by the winners. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by these Official Rules and agree that if any winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated the Official Rules or otherwise does not meet eligibility criteria, prize(s) will be forfeited and awarded to the entry with the next highest score. Entrants understand that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this promotion and acceptance, possession and use of prize (including any travel/activity related thereto). Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. Decisions of Sponsor are final and binding in all respects.
RELEASES: By participating in this contest, Nominators and Nominees agree to release us, Grasshopper Mowers and any other organizations affiliated with the sponsorship, administration, award support, advertisement or marketing of the contest and each of their respective parents, agents, affiliates, subsidiaries, advertising and marketing agencies, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss, damage or death arising in any manner, in whole or in part, directly or indirectly, from participation in this contest and/or acceptance of any awards or prize, including any travel/activity related thereto.
MISCELLANEOUS: By submitting a Nomination, you agree to be bound by these Official Rules. Released Parties are not responsible for lost, late, incomplete, illegible, damaged, inaccurate, stolen, undelivered, garbled, postage-due or misdirected Nominations, videos or postal mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the contest, the processing of Nominations or postal mail, the announcement of the Award Recipients, or in any contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the contest. Released Parties are not responsible for injury or damage to Nominators' or to any other person's computer related to or resulting from participating in this contest or downloading materials from or use of our website. We reserve the right to disqualify any person tampering with the nomination process, the operation of our website or otherwise in violation of these Official Rules. We further reserve the right to cancel, terminate or modify this contest if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention, or any other causes which corrupt or affect the administration, security, fairness, or integrity of the contest. In the event of cancellation or termination, we reserve the right to determine the Award Recipients winner from among all eligible, non-suspect Nominations received prior to date of such action using the judging criteria detailed herein. In the event of a dispute regarding online nomination, Nomination will be deemed made by the authorized account holder of the e-mail account associated with the Nomination and he/she must comply with these Official Rules. The authorized account holder is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
LICENSE FOR USE OF NOMINATIONS: By submitting a Nomination, you grant, and represent and warrant that you have the rights and authority necessary to grant us an irrevocable, non-exclusive, fully sub licensable license and right to exploit, edit, modify, and distribute the Nomination and all elements of such Nomination, including, without limitation, the names or likenesses of any persons, organizations or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to you, the Nominee or any third party.
CHOICE OF LAW/ARBITRATION: Except where prohibited, by submitting a Nomination or accepting an award, Nominators and/or Award Recipients agree that: 1) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Nominators and/or Award Recipients and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of New York without giving effect to any principles or conflicts of law of any jurisdiction; 2) any and all disputes, claims, and causes of action arising out of or connected with this contest, or provision of the awards, shall be resolved individually, without resort to any form of class action; and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at an AAA regional office in New York, NY; (3) judgment upon such arbitration award may be entered in any court having jurisdiction; (4) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this contest but in no event attorneys' fees; and (5) under no circumstances will any Nominator and/or Award Recipient be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
Except where prohibited by law, submitting a Nomination and/or the acceptance of an award or prize by an Award Recipient constitutes permission to use the Nominator's and/or Award Recipient's Nomination, name, hometown, voice, likeness, photograph, and any statements regarding this contest in all media now known or hereafter discovered, for any purpose, including without limitation, in connection with, and to promote, market or advertise, the contest, in whole or in part, or for editorial or public relations purposes on our behalf without compensation, review, approval, credit or attribution, notification or payment from or to the Nominator, Nominee or any person or entity, worldwide, in perpetuity, or on a list of Award Recipients, if applicable. Contest is subject to all U.S. federal, state and local laws and regulations.
